Court Nullifies Kogi APC Delegates List For Governorship Candidate Nomination

An Abuja Federal high court has nullified the Kogi State All Progressive Congress’ delegates list for nominating a candidate for the party in the November governorship election

Justice James Omotosho while delivering Judgement, voided the ward and local government congresses purportedly conducted on February 7 on the grounds that they were not conducted in compliance with the Electoral Act 2022, and the All Progressives Congress constitution.

Justice Omotosho in the Judgment in a suit instituted by a group of aggrieved APC members led by one Realwan Okpanachi, barred the Independent National Electoral Commission, INEC, from according recognition to or using the delegates list that emanated from the congresses of the party for the purpose of selecting its governorship election flag-bearer.

The Judge also agreed with the counsel for the plaintiffs, Ogwu Onoja, SAN that the APC breached section 84 of the electoral act and section 13 of its own constitution by concocting a purported list of delegates and submitting same to INEC without the knowledge of registered members of the party in the state.

The court ordered the APC to conduct fresh congresses in compliance with the Electoral Act and the party’s constitution.
