Updated: Presidential Election Court Dismisses Atiku’s Petition

The Petition of Atiku Abubakar and the PDP was among the three dismissed by the Presidential Election Court on Wednesday

The court resolved all the issues raised against Atiku, holding that the petition lacked merit.

Atiku was not in court, but his associates and party leaders were present to witness the judgment.

The four issues raised in Atiku’s petition had to do with non-compliance with the electoral act and also questioned whether Bola Tinubu scored the majority of lawful votes cast to be declared winner.

Atiku also claimed that Tinubu was not qualified to contest the election having been linked to a fine of narcotics forfeiture in the US.

Much like the court’s reasoning in the case of Peter Obi, the presidential election court held that the allegations were not proved and the pleadings were without material particulars to support the claims made.

The court also upheld its earlier position on the two-thirds vote in the FCT, saying that the constitution does not envisage that the FCT be treated differently from other states but simply as just like any state in the federation for the purposes of a presidential election.

In conclusion, the Presidential Election Petitions Court dismissed Atiku’s case, affirming Bola Ahmed Tinubu as duly elected.
